Despite how quickly AI tools are developing, they still cannot exercise legal judgment, understand nuances, or evaluate credibility. A legal brief is not just a document, but a representation to the court, and carries with it an attorney’s duty of accuracy and accountability. This duty cannot be simply passed onto an AI software program.

In fact, in a recent New York decision, a trial court sanctioned counsel for submitting briefs that relied on hallucinated cases, or citations that did not exist, quotations that were fabricated, and authorities that did not support the statements for which they were cited. When opposing counsel flagged the inaccuracies, the attorney initially attempted to pass them off as paraphrases, however, the court was not persuaded.

 

Even more troubling, is that when the attorney later opposed a motion for sanctions, his filing contained yet another wave of fake citations. These fake citations show an example of hallucinations, one of the most frequent and concerning problems of depending on large language models. Hallucinations are when generative AI programs produce false, nonsensical, or fabricated information and confidently present these as fact. This is especially concerning in legal contexts, where accuracy, accountability, and nuanced judgment are critical. AI lacks true understanding of the law, the facts, and the consequences of its outputs, unlike human attorneys, who are trained to analyze, verify, and take responsibility for every statement submitted to a court.

Furthermore, the problem in this case was also abdication of responsibility. As stated in this article, the court emphasized that,

“In sum, counsel’s duty of candor to the Court cannot be delegated to a software program.”
