Don’t Wait for Court: Getting Financial Compensation Before the Lawsuit

3. Private Disability Insurance

Some victims already have short-term or long-term disability insurance, either privately or through their employer. These policies can help replace income if injuries keep you from working, even before a lawsuit is filed.

One may wonder if there are any risks associated with accepting early compensation. The answer is no, it will not reduce the total damages you may be awarded if you pursue a lawsuit later.

“The law does not punish the victim for having the foresight or intellect to get their own insurance or other protection,” says Lawyer Doug Landau.

However, there can be complications. For example, MedPay can be disputed if the treatment doesn’t meet certain requirements (e.g., if the insurance disputes whether it was “reasonable and causally related”). Furthermore, restitution may require your time and presence at court hearings.

Still, there are many more pros to early compensation, most obviously being the immediate financial relief that can cover urgent medical costs and reduce stress and anxiety. Additionally, you can still pursue full compensation through a lawsuit later if necessary.
