It is not unthinkable for injuries sustained in a car crash to cause problems for the victim many years later.  In a recent case handled by ABRAMS LANDAU Disability Lawyer Doug Landau, that is just what happened.

In this interesting case, the client, a 47-year-old female, was forced to apply for Social Security Disability Insurance benefits (“SSDI”) 10 years after a car wreck.  Why a decade later ? She had been kicked in the neck by a horse!  This woman was involved in a car wreck in 2000, which caused low back and hip pain.  She was then kicked in the neck by a horse in 2008.  After this animal injury, this former accountant had a number of impairments, which taken together, left her unable to work in any Substantial Gainful Activity.  These impairments included:

  • Cervical spondylosis and multi-level herniations,
  • Radiculopathy, with severe muscle spasms from her neck into her hands
  • Chronic low back and hip pain,
  • Chronic Obstructive Pulmonary Disease (COPD), a lung disease which makes it difficult to breathe

  • Post Traumatic Stress Disorder (PTSD),
  • Hepatitis C
  • Anxiety,
  • Depression,
  • Hypertension,
  • Asthma
  • Right eye blindness (and lack of stereoscopic vision), near-sighted

Suffering from severe muscle spasms that go from her neck to her hands, it takes the client 15 minutes just to get up in the morning, and repetitive activity triggers an increase in her symptoms. She does not get a full night’s restful sleep due to the constant pain, which reduces her focus, recall, and memory and increases her anxiety.  Various medical tests provided objective support for the impairments, confirming the following:

  • Cervical Disc herniations at three levels – revealed on MRI
  • Hepatitis C – gallbladder is impacted with stones, per abdominal sonogram
  • Multiple Pain Diagnoses –  from the University of Virginia, Pain Medicine Clinic

After this woman was denied benefits by the Federal Government twice, Landau was able to win this case at the Administrative Law Judge level (at a Hearing).
