Even before the 1900s, there was evidence that boxers and footballers were sustaining head injuries that\u00a0could have lifelong effects. According to this week\u2019s excellent article in <a href=\"https:\/\/www.newyorker.com\/news\/annals-of-inquiry\/the-forgotten-history-of-head-injuries-in-sports?utm_source=nl&amp;utm_brand=tny&amp;utm_mailing=TNY_Daily_021223&amp;utm_campaign=aud-dev&amp;utm_medium=email&amp;utm_term=tny_daily_digest&amp;bxid=5bd6733424c17c1048005f0c&amp;cndid=32321494&amp;hasha=e9a08087be7137e6b2d1189af36d985a&amp;hashb=6336dc34693f58f171521a79114fa6264ee51ace&amp;hashc=2d4f5a8e1233b12732d270df338c3f87ca08d807d6b15d8c67b4a89dddedee30&amp;esrc=AUTO_PRINT&amp;mbid=CRMNYR062419\">New Yorker Magazine<\/a>,<\/div>\n<div>.<\/div>\n<div><\/div>\n<div><\/div>\n<blockquote>\n<div>In 1928, in\u00a0<em>JAMA (the Journal of the American Medical Association)<\/em>, a pathologist named Harrison Martland published the first medical report on punch-drunk syndrome. Martland, who was the chief medical examiner of Essex County, New Jersey, had performed hundreds of brain autopsies on people with head injuries, including a boxer. \u201cFor some time fight fans and promoters have recognized a peculiar condition occurring among prize fighters which, in ring parlance, they speak of as \u2018punch drunk,\u2019 \u201d he wrote; boxers with obvious early symptoms were \u201csaid by the fans to be \u2018cuckoo,\u2019 \u2018goofy,\u2019 \u2018cutting paper dolls,\u2019 or \u2018slug nutty.\u2019 \u201d Drawing on his own investigations and those of his colleagues, Martland concluded that the condition probably arose from single or repeated head blows which created microscopic brain injuries. With time, these small injuries would become \u201ca degenerative progressive lesion.\u201d Mild symptoms manifested as \u201ca slight unsteadiness in gait or uncertainty in equilibrium,\u201d he found, while severe cases caused staggering, tremors, and vertigo. \u201cMarked mental deterioration may set in, necessitating commitment to an asylum,\u201d he warned.<\/div>\n<div>.<\/div>\n<\/blockquote>\n<div>\n<figure id=\"attachment_9866\" aria-describedby=\"caption-attachment-9866\" style=\"width: 308px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-9866\" src=\"https:\/\/landauinjurylaw.com\/theathleteslawyer\/wp-content\/uploads\/sites\/2\/2023\/02\/Evacuation-dkwl-263x300.jpeg\" alt=\"\" width=\"308\" height=\"351\" srcset=\"https:\/\/landauinjurylaw.com\/theathleteslawyer\/wp-content\/uploads\/sites\/2\/2023\/02\/Evacuation-dkwl-263x300.jpeg 263w, https:\/\/landauinjurylaw.com\/theathleteslawyer\/wp-content\/uploads\/sites\/2\/2023\/02\/Evacuation-dkwl.jpeg 406w\" sizes=\"auto, (max-width: 308px) 100vw, 308px\" \/><figcaption id=\"caption-attachment-9866\" class=\"wp-caption-text\">The effects of repeated brain trauma, multiple concussions and head injuries in sports have been known for a long time and published in medical journals. If we ignore the science, we have only ourselves to blame, notes Herndon sports injury lawyer and brain injury prevention advocate, Doug Landau<\/figcaption><\/figure>\n<p>Likewise, in the American version of football, the injury statistics were daunting from the very beginning. However, the sport downplayed the dangers, added padding, an emphasized the manly test of strength that the sport represented. According to the New Yorker piece, by the 1950s, &#8220;punch-drunk syndrome was being described as dementia pugilistica and chronic traumatic encephalopathy.\u201d At that time, almost three quarters of a century ago, &#8220;<b>there was a clear consensus that repeated concussions produce both acute and long-term problems<\/b>.&#8221; In a 1952 journal article a Harvard physician, reviewed \u201cserious recurrent injuries\u201d across college sports and advised that athletes who had more than three head injuries, or who suffered a concussion that resulted in a more-than-momentary loss of consciousness, should avoid further contact sports altogether. \u201cThe college health authorities are conscious of the pathology of the \u2018punch-drunk\u2019 boxer,\u201d he wrote. Lawyer Doug Landau was astounded to read that the NHL did not mandate helmets until the 1970s, despite the fact that the ice is a more unforgiving surface than frozen grass, astroturf and dirt. Cracked skulls should not be\u00a0\u201cpart of the game.\u201d<\/p>\n<\/div>\n<div><\/div>\n<div>The movie \u201cConcussion,\u201d starring Will Smith as Dr. Bennet Omalu, shows the physician conducting autopsies on football players who suffered from\u00a0<b>Chronic traumatic encephalopathy<\/b> (CTE), a disease that has lived in medical journals since 1949. The Centers for Disease Control and Prevention (\u201cCDC\u201d) and the National Institutes of Health (\u201cNIH\u201d) both acknowledge a causal connection between repeated head trauma and C.T.E. Yet, just as with the Asbestos industry, the NFL ignores the science, hires \u201cexperts\u201d to minimize the dangers, and thwart efforts at reform.<\/div>\n<div>.<\/div>\n<div><\/div>\n<div><a href=\"https:\/\/www.youtube.com\/watch?v=VYIWthfMxGA\">Watching the Miami Dolphin quarterback\u00a0Tua Tagovailoa getting sacked in a game\u00a0against the Bengals<\/a>, the fans in the stadium and those watching on television were confronted once with the reality of brain injury in sports.\u00a0 When his hands went spastically to his face, he was exhibiting an\u00a0automatic response known to indicate a serious brain injury. The paramedics placed him on a stabilizing board and loaded him onto a stretcher. He had sustained a concussion in a prior game, and yet the carnage continued. As the New Yorker piece pointed out, &#8220;Everyone knew, after more than a decade of well-publicized research, about the possible long-term effects of\u00a0<a href=\"https:\/\/www.newyorker.com\/culture\/annals-of-inquiry\/exactly-how-dangerous-is-football\" data-uri=\"4a7b43eadc6d0730d2ebeeb39c17caea\">brain trauma experienced by N.F.L. players<\/a>\u2014the higher rates of amyotrophic lateral sclerosis (A.L.S.), of dementia, of mood and personality disorders, of the scourge of chronic traumatic encephalopathy (C.T.E.), a brain disorder brought on by repeated blows to the head.\u201d The warnings should be as blunt as the labels on cigarette packs. The information should start as soon as a child may start playing tackle football. Flag football may not present a significant danger of traumatic brain injury. And the protection of players, and enforcement of the safety rules should be immediate and uniform, since it I unlikely that American football will stop any time soon.<\/div>\n<div><strong>.<\/strong><\/div>\n<div>\n<figure id=\"attachment_9869\" aria-describedby=\"caption-attachment-9869\" style=\"width: 444px\" class=\"wp-caption alignleft\"><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-9869\" src=\"https:\/\/landauinjurylaw.com\/theathleteslawyer\/wp-content\/uploads\/sites\/2\/2023\/02\/testing-bike-LCPS-300x225.jpg\" alt=\"\" width=\"444\" height=\"333\" srcset=\"https:\/\/landauinjurylaw.com\/theathleteslawyer\/wp-content\/uploads\/sites\/2\/2023\/02\/testing-bike-LCPS-300x225.jpg 300w, https:\/\/landauinjurylaw.com\/theathleteslawyer\/wp-content\/uploads\/sites\/2\/2023\/02\/testing-bike-LCPS.jpg 640w\" sizes=\"auto, (max-width: 444px) 100vw, 444px\" \/><figcaption id=\"caption-attachment-9869\" class=\"wp-caption-text\">Education, hands on experience and head protection are the keys to preventing unnecessary skull frqctures and brain injury in children and athletes. Lawyer Landau is shown here at a Title 1 Loudoun County Public School this fall giving out bicycles, helmets, safety booklets, lights, locks, etc. , as part of the ABRAMS LANDAU &#8220;Lids on Kids&#8221; program. With the help of the Virginia Trial Lawyers Foundation, this endeavor has been putting free bike helmets on school children for over a decade.<\/figcaption><\/figure>\n<p><strong>Public Health officials should warn people, inform people &amp; protect people<\/strong> &#8211; so that athletes don&#8217;t get &#8220;punch drunk,&#8221; multiple concussions and end up with CTE.
