Recently, a cyclist was struck by a vehicle when attempting to cross Richmond Highway in Alexandria, Virginia.\u00a0 The driver of a pickup truck was driving on Richmond Highway, and crossed through the intersection with a green light.\u00a0 The cyclist was injured and sent to the hospital; no charges were filed against the driver.<\/p>\n

This brings to mind a case we are working on here at Abrams Landau, Ltd., also involving a cyclist struck and injured by a motorist.\u00a0 Any time there is an accident in a marked intersection, we must find out what was on the crossing sign at the time of the accident.<\/p>\n

The crossing signs at pedestrian intersections take on additional importance in those very few \u00a0jurisidictions (like Virginia, North Carolina & the District of Columbia) where contributory negligence by the injured victim in a street crossing accident can be fatal to their claims.<\/figcaption><\/figure>\n

In the Alexandria case, did the cyclist start to cross during the white “walk” sign, or was the sign orange\/red, with blinking numbers indicating the light was about to turn? \u00a0Some intersections have signs indicating a pedestrian or cyclist should NOT start to cross if the numbers are blinking.\u00a0 What did the sign read during this accident?<\/p>\n
