{"id":4486,"date":"2013-10-21T21:00:50","date_gmt":"2013-10-21T21:00:50","guid":{"rendered":"https:\/\/landauinjurylaw.com\/theathleteslawyer\/?p=4486"},"modified":"2013-10-21T21:00:50","modified_gmt":"2013-10-21T21:00:50","slug":"mayhem-on-the-wod-trail","status":"publish","type":"post","link":"https:\/\/landauinjurylaw.com\/theathleteslawyer\/2013\/10\/21\/mayhem-on-the-wod-trail\/","title":{"rendered":"Mayhem on the W&amp;OD Trail"},"content":{"rendered":"<p>It has been a bad several months for the W&amp;OD Trail in Northern Virginia.\u00a0\u00a0 After summertime incidents of <a title=\"Car Driving on W&amp;OD Trail\" href=\"https:\/\/landauinjurylaw.com\/theathleteslawyer\/2013\/07\/31\/car-driving-on-wod-trail\/\" target=\"_blank\">cars driving onto the trail<\/a>, the latest trouble involve a cyclist and jogger being sent to the hospital with life-threatening injuries after they collided on the trail in Falls Church earlier this month.<\/p>\n<p>What is the problem?<\/p>\n<p>According to Herndon safety lawyer Doug Landau &#8212; himself a frequent user of the W&amp;OD since it runs right by his office in historic Herndon &#8212;\u00a0 it seems that users of the trail are not adhering to some common sense safety rules.<\/p>\n<p>Landau&#8217;s experience, both as an attorney representing the injured and as a trail user, provides him an insider&#8217;s understanding of the problems contributing to the mayhem on the trail:<\/p>\n<ul>\n<li>Wearing earbuds and\u00a0 listening to loud music deprives cyclists and runners of one of their critical senses &#8211; hearing.<\/li>\n<li>Many cyclists and runners do not know the <a title=\"W&amp;OD Rules\" href=\"https:\/\/www.nvrpa.org\/park\/w_od_railroad\/content\/rules\" target=\"_blank\">Rules of the Road<\/a>: &#8220;First Prepare, Be Aware, Show You Care.&#8221;<\/li>\n<li>Signalling with the arms\/hands is rarely done.<\/li>\n<li>Calling out may not be effective for someone listening to music, cell phone, not listening.<\/li>\n<li>We are an international city &#8211;\u00a0 the capital of the free world.\u00a0 Many tourists do not speak English as their primary language and may not understand a call of &#8220;on your left&#8221;.<\/li>\n<li>Runners, walkers, skaters also fail to follow trail rules.\u00a0 They abruptly make a turn for no reason, switch lanes without looking behind, or stop on a dime in the middle of the path.<\/li>\n<li>People do not &#8220;Stop, Look and Listen&#8221; at intersections and crossings.<\/li>\n<\/ul>\n<p>If each and every user of the trail does his or her part to use the trail in a safe manner, we will all benefit.<\/p>\n<p>If you or someone you know has been injured due to no fault of your own &#8212; while using the W&amp;OD Trail or anywhere else &#8212; and there are questions as to what laws apply, <a title=\"email front desk\" href=\"https:\/\/www.landaulawshop.com\/contact.asp\" target=\"_blank\">email<\/a> or call <a title=\"landau law shop web site\" href=\"https:\/\/www.landaulawshop.com\" target=\"_blank\">Abrams Landau, Ltd<\/a>. at once (703-796-9555).<\/p>\n<div><\/div>\n","protected":false},"excerpt":{"rendered":"<p>It has been a bad several months for the W&amp;OD Trail in Northern Virginia.\u00a0\u00a0 After summertime incidents of cars driving onto the trail, the latest trouble involve a cyclist and jogger being sent to the hospital with life-threatening injuries after they collided on the trail in Falls Church earlier this month.
