{"id":3553,"date":"2013-01-25T23:53:02","date_gmt":"2013-01-25T23:53:02","guid":{"rendered":"https:\/\/landauinjurylaw.com\/theathleteslawyer\/?p=3553"},"modified":"2013-01-25T23:53:02","modified_gmt":"2013-01-25T23:53:02","slug":"suit-filed-over-lance-armstrong-books","status":"publish","type":"post","link":"https:\/\/landauinjurylaw.com\/theathleteslawyer\/2013\/01\/25\/suit-filed-over-lance-armstrong-books\/","title":{"rendered":"Suit Filed Over Lance Armstrong Books"},"content":{"rendered":"<div>A class-action lawsuit has been filed by the readers of Lance Armstrong&#8217;s inspirational books following the cyclist&#8217;s admission of ongoing steroid usage.\u00a0 The suit against Armstrong and his publisher claims that the athlete&#8217;s repeated and vehement denials of using steroids deceived readers.\u00a0 The readers feel betrayed, and they want their money back!<\/div>\n<div><\/div>\n<div>Virginia cyclist and lawyer Doug Landau, of Abrams Landau, Ltd., believes that if the books were <strong>published as non-fiction<\/strong> as opposed to purely inspirational, then Mr. Armstrong may have some explaining to do.<\/div>\n<div><\/div>\n<div>&#8220;As long as the case is centered on the intent to mislead readers &#8212; and profit thereby &#8212; there may be something to it,&#8221; says Doug.\u00a0 &#8220;It&#8217;s an interesting question:\u00a0 <strong>can purchasers and readers of a book that contains material statements of fact (1) that are false and (2) that the author knows to be false at the time, bring a cause of action for their money back ? \u00a0Are they entitled to anything more ?<\/strong> \u00a0I think that if I were the judge, <!--more-->I would award a refund, but only against Mr. Armstrong, not the publisher.\u00a0 Unless, of course, the evidence shows the publisher, supplier and booksellers were in cahoots. \u00a0But as to anything more, probably not.&#8221;<\/div>\n<div><\/div>\n<div>This case may ring a bell.\u00a0 For an example of a book that was based on falsehoods outside of the sports world that resulted in a settlement, <a title=\"Landau Law Injury Post\" href=\"https:\/\/landauinjurylaw.com\/index.php\/2013\/01\/25\/can-an-author-who-lies-be-held-responsible\/\" target=\"_blank\">click here<\/a>.<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A class-action lawsuit has been filed by the readers of Lance Armstrong&#8217;s inspirational books following the cyclist&#8217;s admission of ongoing steroid usage.\u00a0 The suit against Armstrong and his publisher claims that the athlete&#8217;s repeated and vehement denials of using steroids deceived readers.\u00a0 The readers feel betrayed, and they want their money back!
