As a biker who often starts his rides from his own driveway, this report of a fatal bike crash hits particularly hard.\u00a0 A cyclist was starting his morning bicycle ride in front of his home when he was hit by a van while coming out of his driveway. The death of the cyclist prompted a lawsuit by the man’s family against the driver of the car that hit him. The suit accuses the defendant of “failing to keep a proper lookout, not exercising due care in operating a motor vehicle and violating the law by following too closely.” According to news report<\/a>s, the wrongful death lawsuit was filed in Georgia Federal Court seeking more than $75,000 in damages. The 68-year-old biker died two days later from injuries he sustained in the accident.\u00a0 The lawsuit alleges, the Defendant’s \u201cfailure to observe the roadway ahead and failure to yield the right of way was the proximate cause of [Plaintiff]\u2019s injuries and subsequent death.\u201d The lawsuit also alleges that the motorist failed to stop or keep the van from striking the bicycle. The lawsuit contends that the Plaintiff was in the process of mounting his bicycle when hit. However, the County Sheriff\u2019s Office accident report states that the Plaintiff \u201cwas operating\u201d his bicycle in his driveway, \u201cfailed to yield the right of way\u201d and \u201cpulled into (the van\u2019s) path\u201d. The report also states that the Defendant\u2019s van \u201ccould not avoid the collision and struck the bicycle with its passenger front bumper.\u201d The Plaintiff was thrown onto the van and then fell off on the ground, the report stated.<\/p>\n

Photos taken by law enforcement within minutes of the crash, the report stated, indicate the rising sun had a \u201csevere effect on vision for eastbound traffic.\u201d\u00a0 The report further stated that the Defendant was traveling East. Part of the controversy is whether the driver ever saw the biker.\u00a0 In the Defendant motorist’s video deposition, she agreed that she never saw the cyclist, thought she\u2019d hit a mailbox upon feeling the impact and did not realize her neighbor had been hit until she got out of the van. Also, the Defendant driver stated the sun was \u201cnot blinding to the point you can\u2019t see.\u201d The federal lawsuit seeks a jury trial, reimbursement of $70,254.92 in medical expenses and $5,976.05 in funeral expenses. The lawsuits also asks for damages representing the full value of\u00a0 the Plaintiff\u2019s life to be determined by jurors.
