{"id":8918,"date":"2023-10-30T05:36:34","date_gmt":"2023-10-30T05:36:34","guid":{"rendered":"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/?p=8918"},"modified":"2023-09-14T14:47:09","modified_gmt":"2023-09-14T14:47:09","slug":"what-does-the-faa-consider-a-serious-injury-on-an-aircraft-or-at-an-airport","status":"publish","type":"post","link":"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/2023\/10\/30\/what-does-the-faa-consider-a-serious-injury-on-an-aircraft-or-at-an-airport\/","title":{"rendered":"What does the FAA consider a &#8220;Serious Injury&#8221; on an aircraft or at an airport?"},"content":{"rendered":"<div>The Federal Aviation Administration is\u00a0<em>responsible for the safety of civil aviation.\u00a0<\/em>They are responsible for ensuring the safety of aircraft, managing transportation, and regulating operations.<\/div>\n<div>.<\/div>\n<div><\/div>\n<div>\n<blockquote>\n<h5><em>&#8220;The FAA and the National Transportation Safety Board (NTSB) define an accident\u00a0as an occurrence associated with the operation of an aircraft which takes place between the time any person boards the aircraft with the intention of flight and all such persons have disembarked, AND in which any person suffers death or\u00a0<u>serious injury<\/u>\u00a0or in which the aircraft receives\u00a0<u>substantial damage<\/u>. \u00a0The NTSB regulations (49 CFR part 830) define &#8220;serious injury&#8221; and &#8220;substantial damage&#8221; as follows:&#8221;<\/em><\/h5>\n<\/blockquote>\n<p>A <a href=\"https:\/\/www.faa.gov\/faq\/what-constitutes-post-accident-test-what-definition-accident#:~:text=The%20FAA%20and%20the%20National,any%20person%20suffers%20death%20or\"><strong>Serious<\/strong><strong> Injury<\/strong><\/a>\u00a0means any injury which:<\/p>\n<ul>\n<li>\n<figure id=\"attachment_8926\" aria-describedby=\"caption-attachment-8926\" style=\"width: 300px\" class=\"wp-caption alignright\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-8926 size-medium\" src=\"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/wp-content\/uploads\/sites\/3\/2023\/09\/IMG_1781-300x202.jpg\" alt=\"\" width=\"300\" height=\"202\" srcset=\"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/wp-content\/uploads\/sites\/3\/2023\/09\/IMG_1781-300x202.jpg 300w, https:\/\/landauinjurylaw.com\/airportinjurylawyer\/wp-content\/uploads\/sites\/3\/2023\/09\/IMG_1781.jpg 640w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><figcaption id=\"caption-attachment-8926\" class=\"wp-caption-text\">&#8220;The Federal Aviation Act of 1958 created the agency under the name Federal Aviation Agency&#8221;<\/figcaption><\/figure>\n<p>&#8211; (1) Requires hospitalization for more than 48 hours, commencing within 7 days from the date of the injury was received;<\/li>\n<li>&#8211; (2) results in a fracture of any bone (except simple fractures of fingers, toes, or nose);<\/li>\n<li>&#8211; (3) causes severe hemorrhages, nerve, muscle, or tendon damage;<\/li>\n<li>&#8211; (4) involves any internal organ; or<\/li>\n<li>&#8211; (5) involves second or third-degree burns, or any burns affecting more than 5 percent of the body surface.\u201d<\/li>\n<\/ul>\n<p>The Code of Federal Regulations defines how an accident is seen in <a href=\"https:\/\/www.ecfr.gov\/current\/title-49\/subtitle-B\/chapter-VIII\/part-830\/subpart-A\/section-830.2\">\u00a7 830.2<\/a><\/p>\n<blockquote>\n<h5><em>An aircraft accident &#8220;means an occurrence associated with the operation of an aircraft which takes place between the time any person boards the aircraft with the intention of flight and all such persons have disembarked, and in which any person suffers death or serious injury, or in which the aircraft receives substantial damage. For purposes of this part, the definition of \u201caircraft accident\u201d includes \u201cunmanned aircraft accident,\u201d as defined herein.&#8221;<\/em><\/h5>\n<\/blockquote>\n<p>How to prevent an injury on an airplane?<\/p>\n<p>First, always be cognizant of your surroundings. Whether that means being aware of other passengers, watching your head, or securing your luggage, it is important to recognize any potential obstacles that may interfere. The crew and cabin members are trained on how to deal with emergencies.<\/p>\n<p>Keeping your safety belt fastened can help prevent a head or other injury during clear air turbulence or sudden side shear wind impact.<\/p>\n<p>In addition, wearing proper footwear can mean the difference between you and a slip-and-fall.<\/p>\n<p>Some accidents are inevitable and the airline may be responsible for what is defined as &#8220;substantial damage.&#8221;<\/p>\n<blockquote>\n<h5><em>&#8220;Substantial damage means damage or failure which adversely affects the structural strength, performance, or flight characteristics of the aircraft, and which would normally require major repair or replacement of the affected component.
