{"id":205,"date":"2013-01-08T06:08:59","date_gmt":"2013-01-08T06:08:59","guid":{"rendered":"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/?p=205"},"modified":"2017-08-04T16:19:50","modified_gmt":"2017-08-04T16:19:50","slug":"airport-injury-lawyer-doug-landau-urges-virginia-to-fill-fairfax-judge-vacancies","status":"publish","type":"post","link":"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/2013\/01\/08\/airport-injury-lawyer-doug-landau-urges-virginia-to-fill-fairfax-judge-vacancies\/","title":{"rendered":"Airport Injury Lawyer Doug Landau Urges Virginia to Fill Fairfax Judge Vacancies"},"content":{"rendered":"<p><a href=\"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/2013\/01\/09\/airport-injury-lawyer-doug-landau-urges-virginia-to-fill-fairfax-judge-vacancies\/greenville-county-courthouse\/\" rel=\"attachment wp-att-211\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-medium wp-image-211\" title=\"greenville county courthouse\" src=\"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/wp-content\/uploads\/sites\/3\/2013\/01\/greenville-county-courthouse-225x300.jpg\" alt=\"\" width=\"225\" height=\"300\" srcset=\"https:\/\/landauinjurylaw.com\/airportinjurylawyer\/wp-content\/uploads\/sites\/3\/2013\/01\/greenville-county-courthouse-225x300.jpg 225w, https:\/\/landauinjurylaw.com\/airportinjurylawyer\/wp-content\/uploads\/sites\/3\/2013\/01\/greenville-county-courthouse-768x1024.jpg 768w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/a>Virginia Governor Bob McDonnell has proposed funding for <strong><em>only 15 of 44 vacant judgeships statewide<\/em><\/strong>.\u00a0 Fairfax, currently down four judges, is not on the list to receive any new judges.<\/p>\n<p>On numerous occasions, Airport Accident Attorney Doug Landau has arrived at the Fairfax Circuit Court with his clients &#8212; many of whom are injured airline employees or victims of airport accidents &#8212;\u00a0 only to learn that there were not enough judges on that day !\u00a0\u00a0 But since we at ABRAMS LANDAU typically invest the time, effort and money to have our treating doctor&#8217;s deposition videotaped, we were asked to come back on another day !<\/p>\n<p>As far as Landau is concerned, <em>&#8220;Justice Delayed Is Justice Denied.&#8221;<\/em><\/p>\n<p>Fairfax is not on the list for funding for judicial slots due largely to the way caseload is measured:<\/p>\n<ul>\n<li>Fairfax considers a criminal case as one case, no matter how many charges are brought against the defendant, while most other jurisdictions treat each charge separately; and<\/li>\n<li>Civil cases, which are much more common and more complex in Fairfax, are not considered in the measurement.\u00a0 These cases require considerable more <img decoding=\"async\" title=\"More...\" src=\"https:\/\/landauinjurylaw.com\/wp-includes\/js\/tinymce\/plugins\/wordpress\/img\/trans.gif\" alt=\"\" \/> judicial resources than criminal cases.<\/li>\n<\/ul>\n<p>If these errors in calculation are corrected <!--more-->(as we hope they will be at the conclusion of the Supreme Court&#8217;s ongoing study of judicial workload next November), it will be clear that the caseload in Fairfax means that the judicial vacancies must be filled.<\/p>\n<p>In the meantime, a shortage of judges means delays in cases being tried in Fairfax County.\u00a0 For this reason, Herndon attorney Doug Landau urges his clients and colleagues to contact their local representatives in the Virginia General Assembly by email, phone, or by letter.\u00a0 <a title=\"VA Delegation contact info\" href=\"https:\/\/www.fairfaxbar.org\/associations\/4650\/files\/NOVADelegation.pdf\" target=\"_blank\">Click here<\/a> for contact information for members of the Northern Virginia Delegation.<\/p>\n<blockquote><p>Lawyer Landau is following the lead of the Fairfax Bar Association by saying, &#8220;Join me in telling our representatives that Virginia cannot postpone filling at least one of two vacant General District Court seats and one of two vacant Circuit Court seats, positions that are necessary in order to uphold and fulfill the Commonwealth&#8217;s constitutional obligation to its citizens.\u00a0 Underfunding of our judicial system has a critical impact in Fairfax County, with its population of more than 1,100,000 people.\u00a0 The judicial caseload is enormous and we cannot tolerate our citizens and businesses being denied timely and prompt access to efficient justice.
