Where do I go to meet my Abrams Landau team before and after my Hearing at the Virginia Workers Compensation Commission in Manassas ?

Since the judges do not like people talking while Hearings are going on, there are small conference rooms available where Herndon “Super Lawyer” Doug Landau can Manassas conf room Doug Landau.JPGmeet clients, witnesses, experts and review the VWC OFFICIAL FILES.  Very often, this is a good place to collect one’s thoughts before ntering the Hearing room and testifying in an injury or occupational disease claim.  These conference rooms are also where witnesses who have been asked to wait outside of the Hearing room can stay until they are summoned by the bailiff or clerk to testify under oath.  Shown here is one such room at the Manassas Hearing location, located to the left of the Clerk’s office.  These rooms are found at “Sudley Tower”, off Route 234, just South of Route I-66 in Manassas, where Doug Landau routinely tries spinal cord surgery, broken bone, deep wound, infection, joint replacement, brain trauma, amputation, burn, chemical injury, disease, concussion, and other permanently disabling condition cases.

Why was this Abrams Landau client’s case so unusual ?

This hardworking woman worked not one, two, but three jobs for different employers at Washington Dulles International Airport !   Because the three jobs were “similar” employment, Mr. Landau sought to have the wages FROMA ALL 3 JOBS combined in the calculation of her pre-injury average weekly wage. This effort by experienced workers comp trial lawyer Doug Landau would have the effect of increasing her weekly workers comp checks.

He also proved that she was given uniforms by the airline she worked for as well as the global package and delivery company and money for uniforms from FedEx. Mr. Landau is especially proud of the several clients who attended, asked questions and learned while still on crutches and recovering from their catastrophic injuries from their car crashes, ladder falls, airplane injuries, spine trauma, brain injuries, TBI, back operations, orthopedic surgeries, truck accidents, and disability causing conditions.

Shown here are the outside of the workers comp Hearing VWC Hearing Room Manassas Abrams Landau case.JPGroom in Manassas, where the Herndon law firm of Abrams Landau, Ltd. presents cases for clients who have sustained: fractures, herniated discs, traumatic brain injury (’TBI”), lacerations, burns, crushed bones, concussions, chemical inhalation, toxic substance reactions and occupational diseases.  Note that the case names are posted along with the lawyers, like Doug Landau, who are representing the parties.

Here are pictures taken after Washington, D.C., Richmond and Herndon Virginia “Super Lawyer” Doug Landau’s most recent trial before the Workers Compensation Commission. Following the advice of this Herndon law firm, Abrams Landau, Ltd. clients from Michigan, Mexico, Virginia and El Salvador watched and listened Doug Landau Manassas VWC Hearing Room.JPGas a recently transplanted New York client testified in her workplace injury case.

Doug Landau’s client had been in a vehicle crash while operating a luggage tug at the Airport’s “Air Operations Area” (”AOA”). Her ankle had been crushed and she needed rods and pins surgically implanted to repair the damage to her leg. Mr. Landau visited her at her home in Herndon. She also, while still walking with crutches, attended another of his Hearings, in order to see where to go, where to park, what happens and to ask questions of one of the “Best Lawyers in America” afterwards. What is more, this Abrams Landau client is bilingual, and the Hearing she observed in Manassas, was conducted in English AND Spanish, because that Landau Law Shop client needed the assistance of a (free !) Court-Appointed Translator.  Note that the Hearing room has microphones to record the proceedings. Continued tomorrow…

Experienced Herndon trial lawyer Doug Landau has been voted into “The Best Lawyers In America,” “Super Lawyers” and the highest rating available in the Martindale Hubbell directory of Lawyers in the United States. Despite these honors, there are simple, common sense actions that should be taken after a car wreck, dog bite, bike crash, trip and fall, animal attack, defective premises, or other personal injury causing event. The Herndon injury lawyer Doug Landau recommends:

Broken Bike Helmuts Doug Landau Abrams Landau Ltd*Photographs should be taken as soon as possible.
*You should save the defective product or parts.
*Write down what happened: include names, addresses and phone numbers of the other people involved in the accident and all witnesses at the scene.
*Identify the vehicles involved or the injury causing product.
*Make a diagram of your location before, during and after the accident.
*Include measurements of such things as skidmarks, landmarks and warning signs.

*Preserve the evidence: do not wash bloody clothing, broken footwear or throw out a cracked bicycle helmut.  Label these things, put them in zip lock bags and give them to your lawyer.

One of the reasons to retain experienced legal counsel as soon as possible after a catastrophic car accident, dog attack, bike crash or trip and fall causing brain injury is because a qualified trial lawyer will start investigation so that your case can be presented with the evidence necessary to win.

What kinds of things will counsel do for you after you’ve been smashed, crashed, bashed or trashed ?
An experienced lawyer like Doug Landau and the trial team at Abrams Landau, secure such evidence as:
1. Pictures of the vehicles,
2. Photographs of the accident scene,
3. Images, with scale markers, of the defective products
4. Medical Illustrations and/or photos of the injuries and medical apparatus used to treat the injured plaintiff,
5. Receipts, photographic records and perhaps the items themselves for the property damage claim.
6. Weather reports, news clippings, and other relevant notes from periodicals and local newspapers.
7. The Defendant’s other infractions, convictions, litigation history and case histories.

Doug Landau & VT Police at TechDoug Landau often meets with the police officers who investigated his clients’ accidents. Landau notes that it is not unusual for these meetings to result in additional information not contained in the official “Police Accident Report.” The Herndon “Super Lawyer” observes that his in-person discussions with the investigating officers reveals facts not even found in the Traffic Court trial transcript. Plus, it is important to meet with every witness well BEFORE they take the witness stand and testify in an Abrams Landau trial. In the Photograph, Virginia Injury Lawyer Doug Landau is shown during a meeting with a Virginia Tech Police Officer. Landau’s meeting was part of the investigation in a case where a Tech athlete was struck and knocked out by a truck in the middle of the campus. The team at Abrams Landau, Ltd. was able to get their client a large settlement due to the early and thorough investigation, which included Mr. Landau’s multiple trips to Blacksburg to get statements from all of the relevant eyewitnesses. Tomorrow’s posting will list some of the things YOU can do to help your own case or that of a friend, family member or neighbor.

After an injured worker receives 500 weeks of compensation benefits, the insurance carrier generally sends a letter telling the injured worker that they only have medical benefits remaining.

However, Super Lawyer Doug Landau of the Abrams Landau law firm in Herndon, Virginia has had success in getting additional wage loss compensation for his disabled clients. He has won and settled cases even after the insurance company and their lawyers said the indemnity wage loss claim was over and they would pay no more compensation benefits.

While the insurance industry likes to publicize instances where the claims of injured workers are not legitimate, these “exposes” pale in comparison to the recent verdict in Florida. This Jacksonville case involved fraud in the context of workers comp insurance and involved almost $100 million dollars ! After five weeks of testimony, a Jacksonville Florida jury convicted three business owners late last Wednesday in a nationwide employee leasing conspiracy that defrauded hundreds of thousands of workers out of insurance benefits.
The men face life prison sentences and fines totaling $17 million. In addition, federal prosecutors asked a judge for forfeitures totalling $78 million in assets they say were proceeds of the scheme. “We will continue to seek renumeration for these injured employees (more…)

The recent verdict from Montgomery County, Virginia underscores what Herndon lawyer Doug Landau has been emphasizing for years: that the amount of medical bills and lost wages are not subject to some formula to calculate settlement or likely verdict outcomes.

In the Blacksburg Virginia Triathlon case, a bicyclist crashed into a car when it ran the stop sign on the local college Campus. The triathlete smashed into the passenger’s side of the car, shattering the glass and knocking fragments onto the driver. The cyclist, racing in the second leg of the triathlon, was heard gasping for breath at the scene. The triathlete was rushed to the local hospital but died there shortly after the impact.

The driver suffered no physical injuries. (more…)

The answer is “yes.”
With the recent verdict in a fatal bike crash case in Montgomery County, Triathlon Trial Lawyer Doug Landau points out that we can see that not only can both sides of a crash case lose, due to contributory negligence and assumption of the risk, but both sides can also win when there are negligent third parties involved.
In the Blacksburg Triathlon case, the bicyclist who died (more…)

A recent caller to ABRAMS LANDAU asked, ” Are attorney’s fees in workers comp claim 1/3 like in car accident and bike crash cases ?”
